Plaintiff, a deaf man with a cochlear implant who was a senior technical manager, alleged discrimination and constructive discharge by his employer claiming he was denied a promotion, harassed and retaliated against for protesting the alleged discrimination due to his hearing loss.  When plaintiff’s assistant was laid off in a mass layoff, plaintiff was forced to use the telephone, which was painful. The technical assistant, who was rehired after the plaintiff complained, testified that the CEO had made biased comments about plaintiff’s deafness.  Plaintiff took medical leave and later resigned.  Verdict for the defense (12-0).
