A deaf man who was beaten and arrested for resisting law enforcement personnel after police officers entered his home without a warrant to remove his granddaughter in a custody dispute sued the officers and the city alleging violation of the ADA and Section 1983. The defendants' motion for summary judgment was granted in part and denied in part: The grandfather was not a "qualified individual" under the state statute governing local child protective services. He was entitled to know why the officers were there and by what authority. A genuine issue of material fact existed as to whether plaintiff was arrested because of his disability; specifically whether defendants knew or should have known plaintiff was deaf yet refused to communicate with him and then arrested him because he did not respond appropriately.
